Welcome to smul.app! These Terms of Service ("Terms") govern your access to and use of the smul.app website and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service. 

1. Acceptance of Terms

By creating an account, accessing, or using smul.app, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and warrant that you have the authority to bind that organization to these Terms. 

2. Description of Service 

Smul.app provides a URL shortening service, allowing users to convert long URLs into shorter, more manageable links. The Service may also offer features such as link tracking, custom short links, and analytics, which may be subject to additional terms or fees. 

3. User Accounts

Account Creation: To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. Account Security: You are responsible for safeguarding your password and for any activities or actions under your account. Smul.app cannot and will not be liable for any loss or damage arising from your failure to maintain the security of your account and password. Prohibited Use: You must not use the Service for any illegal or unauthorized purpose. You agree to comply with all local laws regarding online conduct and acceptable content. 

4. Acceptable Use Policy

You agree not to use the Service to: Shorten URLs that lead to illegal, harmful, threatening, defamatory, obscene, harassing, or racially, ethnically, or otherwise objectionable content. Shorten URLs that contain viruses, malware, or any other harmful code. Engage in spamming, phishing, or any other deceptive or fraudulent activities. Infringe upon the intellectual property rights of others. Circumvent any technological measure implemented by smul.app or any of smul.app's providers or any other third party (including another user) to protect the Service. Attempt to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Service. Interfere with, or attempt to interfere with, the access of any user, host, or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Service. Smul.app reserves the right to remove any shortened URL or terminate any account that violates this Acceptable Use Policy, without prior notice. 

5. Intellectual Property

Smul.app Content: All intellectual property rights in the Service, including but not limited to, software, design, text, graphics, logos, and trademarks, are owned by smul.app or its licensors. You may not use any of smul.app's trademarks without our prior written permission. User Content: You retain ownership of any content you submit, post, or display on or through the Service, including the original URLs you shorten. By submitting, posting, or displaying content, you grant smul.app a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods (now known or later developed) solely for the purpose of providing and improving the Service. 

6. Disclaimers

The Service is provided "as is" and "as available" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Smul.app does not warrant that the Service will be uninterrupted, secure, or error-free. 

7. Limitation of Liability 

To the maximum extent permitted by applicable law, in no event shall smul.app, its affiliates, directors, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose. 

8. Indemnification

You agree to defend, indemnify, and hold harmless smul.app, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms. 

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Service. 

10. Governing Law

 These Terms shall be governed and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions. 

11. Changes to Terms

 We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
